USCIS has officially announced the H-1B cap registration timeline for FY 2027. As we approach the opening of the registration period, it's important to note that this year’s process is focused not just on timing but also on pay levels, skill prioritization, and costs.

Key Dates to Keep in Mind:

  • Initial Registration Window: Opens on March 4, 2026, at 12:00 PM Eastern and closes on March 19, 2026, at 12:00 PM Eastern.
  • Registration Fee: $215 per beneficiary
  • Beneficiary Details & Payments: Can only be submitted electronically via a USCIS online account starting March 4.

Selection Timeline:

  • USCIS will begin conducting selections after March 19, 2026.
  • Notifications of selection are expected by March 31, 2026. These notifications will be sent exclusively through the USCIS online account.
  • If not selected, the H-1B petition cannot be filed, including for U.S. Master’s cap cases.

Important Legal Update for FY 2027:
Petitioners may file an H-1B cap-subject petition only if their beneficiary’s registration is selected. There are no exceptions to this rule.

New Framework for FY 2027:
DHS has introduced a new selection process:

  • If registrations exceed the cap, USCIS will prioritize higher-paid and higher-skilled beneficiaries.
  • The objective is to protect U.S. wages, limit low-wage outsourcing, and refocus the H-1B program on "specialty" occupations.

Additional Consideration for Employers:
On September 19, 2025, President Trump issued a proclamation that may affect employers sponsoring H-1B workers. If selected, certain employers may need to pay an additional $100,000 fee as part of the H-1B filing process.

How to Apply:
The registration process is fully electronic, and it’s essential to follow the timeline to secure a spot. Ensure that all details are submitted accurately and on time.
